Step 3 · Terms of usage

Please review and accept our service agreement before continuing. By using RabiMail you also agree to our Acceptable Use Policy and Data Processing Addendum.

1. Service Agreement

This Service Agreement is between you ("Customer") and Kadyan Industries Pvt Ltd ("RabiMail", "we", "us"), an Indian private limited company with registered office in Jaipur, Rajasthan (CIN U72900RJ2023OPC089456). By creating an account, you agree to be bound by these terms.

2. Subscription & Billing

Your free trial lasts 30 days. After the trial, your selected plan auto-renews monthly or annually unless cancelled. All fees are charged in advance. Cancellation takes effect at the end of the current billing period.

3. Acceptable Use

You agree not to use RabiMail to send spam, phishing, or other unsolicited communication. You will obtain explicit consent from recipients before sending marketing email. You will not use the platform to harass, defraud, or violate the rights of any person.

4. Data Protection (DPA)

We process your data in accordance with the Digital Personal Data Protection Act, 2023 (DPDP). For EU customers, we comply with GDPR. You are the Data Controller; we are the Data Processor. Sub-processor and data flow details are listed in our DPA.

5. Service Availability

We commit to 99.9% monthly uptime for Cloud customers. Service credits apply for downtime exceeding the SLA. Self-hosted deployments are operated by you and not covered by our SLA.

6. Intellectual Property

RabiMail retains ownership of all platform IP. You retain ownership of all data, content, and customizations you create. We grant you a non-exclusive, non-transferable license to use the platform during the subscription period.

7. Termination

Either party may terminate this agreement for material breach with 30 days written notice. Upon termination, we provide 30 days for data export, after which all customer data is permanently deleted.

8. Governing Law

This Agreement is governed by the laws of India. Disputes shall be resolved in the courts of Jaipur, Rajasthan, except where mandatory consumer protection laws apply.
